1. Constitution of Special Investigating Team – sharing of information.

In pursuance of the Hon’ble Supreme Court Judgment dated July 4, 2011, Government of India has constituted a Special Investigation Team (SIT) under the Chairmanship of Hon’ble Justice M.B. Shah. In this regard, the Hon’ble Supreme Court has directed that:

“All organs agencies, departments and agents of the State, whether at the level of the Union of India, or the State Government, including but not limited to all statutorily formed individual bodies, and other constitutional bodies extend all the cooperation necessary for the functioning of the Special Investigation Team.

The Union of India and where needed the State Government will facilitate the conduct of the investigations, in their fullest measures, by the Special Investigation Team and functioning, by extending all necessary financial, material, legal, diplomatic and intelligence resources, whether such investigations or portions of such investigations occur inside the country or abroad.”

In view of the above, RBI has vide its circular A. P. (DIR Series) Circular No. 18 dated July 30, 2014 advised all Authorized Persons to ensure that information/documents required by the SIT are made available, as and when required.

2. Levy of foreclosure charges/pre-payment penalty on Floating Rate Loans.
RBI  has vide its circular DNBS(PD).CC.No.399/03.10.42/2014-15 dated July 14, 2014 advised as a measure of customer protection and also in order to bring in uniformity with regard to prepayment of various loans by borrowers of banks and NBFCs, that NBFCs shall not charge foreclosure charges/ pre-payment penalties on all floating rate term loans sanctioned to individual borrowers, with immediate effect.

3. Guidelines for Issue of Commercial Paper

RBI has vide its circular IDMD.PCD.04/14.01.02/2014-15 dated July 1, 2014 issued a Master Circular incorporating all the existing guidelines/instructions/ directives on Issue of Commercial Paper for reference of the market participants and others concerned. It may be noted that this Master Circular consolidates all the instructions/guidelines/notifications contained in the circulars listed in the Appendix in so far as they relate to guidelines for issue of CP.
